The following rules apply for tours purchased from PARTY B.
Booking takes place in written directly to PARTY B. Booking is finally confirmed when the balance has been paid (see 'payment') and when you have received a final written confirmation/voucher issued by PARTY B. From this moment on a travel agreement exists between two parties.
Tour service must depend on the individual tour Itinerary.
Payment should be made sixty days prior to the tour. PARTY B issues an invoice for the total balance, which must be paid six weeks before the departure date. Especially flight tickets will not be issued before PARTY B has received payment for the services ordered by Party A. International flight tickets ordered via PARTY B will be sent to PARTY A before departure from PARTY A’s home country while tickets for domestic flights within China will be handed over to PARTY A right after arrival to China.
3. Cancellation by the customer
Cancellation must be done in written. If Tour Cancellation Protection Plan is not taken, following applies:
Up to 48 days prior to departure 10% of cost per person
47-28 days prior to departure 10% of cost per person
27-20 days prior to departure 15% of cost per person
19 - 14 days prior to departure 25% of cost per person
13-2 days prior to departure 75% of cost per person
1 day or less 100% of tour cost per person.
PARTY B recommends the customer to take out cancellation insurance.
PARTY B is a liable tour operator, who acts on behalf of shipping companies, airlines and hotels/guest houses etc. included in the tour arrangements and is not liable for circumstances affecting the above companies, or for delays or losses, damage or costs incurred by circumstances beyond the control of PARTY B.
PARTY B also reserves the right to make changes to the itinerary (both before and after booking has been confirmed) in the interest of customer's safety and comfort. Changes may also be made in order to provide assistance to e.g. groups or stranded persons. Providing assistance in this way is normal in areas such as these (e.g. during a trekking in mountainous areas), and shall be regarded as a part of the journey insofar as the occurrence cannot be said to have adversely affected the journey in general to a significant degree. Different conditions can lead to delays for flights and ships. Weather conditions can lead to difficult supply conditions and limited availability of services.
5. Customer's obligations
The customer must adhere to regulations concerning conduct and guidelines given by the PARTY B reserves the right to refuse admittance to a trip if the customer is considered a safety liability, or if the customer behaves in such a way that he/she is of nuisance to the other participants on the trip.
6. Changes in price
We reserve the right to change the prices without prior notice. The price of the tour can only be changed up to 20 days before departure after a confirmed booking. This may be necessary due to unforeseen changes in duties, taxes or transport costs. Should a price increase of this nature be in excess of 10% of the price of the tour, the customer is entitled to cancel the arrangements with full compensation.
PARTY B reserves the right to cancel any departure due to insufficient bookings up to four weeks. Due to force measures or other circumstances beyond the control of PARTY B which prevent the customer taking the tour.
If no reason cancellation, the compensation will be paid to the tourists by PARTY B.
48 days or more prior to departure 5%, 47-28 days 10%, 27-20 days 15%, 19-14 days 25%, 13- 2 days 75%, 1 day or less 100%.
10. Legal settlements
All the activities by this agreement don’t contradict the legislation of parties. Any dispute between the buyer and PARTY B is to be settled by Chinese Court.
11.1. Damage inflicted to the tourist’s health must be paid in order with the legislation of the country of stay.
11.2. The foreign tourist on the spot must pay Damage inflicted because of the foreign tourist’s fault by cash in full volume.
11.3. Neither Party is liable for accidents happened because of misconduct of foreign tourists, not for any changes in schedule or delay of transports. However, Parties will do their best to remove the conflict and render the reasonable help to the tourists.
11.4. Neither Party is responsible for the complete or partial failure of mutual obligations under this Agreement because of Force Majuro (Acts of God, fire, military actions, political unrest, strikes, decisions of government, etc.).
11.5. Claims of tourists for not given or insufficient quality of services will be accepted mutually by the Parties during 90 days after the last service date and studied during 30 days. If claims are considered reasonable, the compensation will be paid to the tourists.
11.6. Damage inflicted to the tourist’s health must be paid in order with the legislation of the country of stay. We will depend on the insurance for the atonement, If the tourist buy it from us.
11.7 Tourist must take care of their personal and valuable things, we have no responsibility for your loss
11. Extra payment
The PARTY B shall propose to the Tourists on itinerary under this Agreement the following services for extra payment. But all the extra payment must get tourists permission by themselves.
:• Additional excursions including entrance Fees to museums, palaces, gardens and other places of seeing;
• Visiting different spectacles;
• Visiting national cuisine restaurants;
• Visiting sports measures, exhibitions, etc.
12. Extra terms:
